Terms of Service

These Terms are the agreement between you and Recess for using the Recess macOS app. They are written to be readable. If anything is unclear, email us.

1. Agreement

  • By downloading, installing, or using Recess, you agree to these Terms and to the Privacy Policy.
  • If you do not agree, do not install or use the app. Uninstall it from your Mac to stop using it.

2. Your License

  • We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Recess on Macs you own or control, in line with the Mac App Store's Licensed Application End User License Agreement.
  • You may not copy, redistribute, resell, sublicense, decompile, or reverse-engineer the app, except to the extent the law expressly permits.

3. System Permissions You Grant

Recess only works because you grant it specific macOS permissions. You are responsible for managing those permissions:

  • Calendar access: required for meeting reminders. Revoking it disables reminders.
  • Notifications: required for nudges and break prompts.
  • Screen recording: optional. Used only to render a blurred backdrop behind the meeting-reminder and break overlays. Without it, those overlays show a plain background.
  • Google Calendar: optional. Connect it in Settings to surface Google events; disconnect at any time to revoke access.
  • Launch at login: optional, lets Recess start with your Mac.

You can revoke any permission at any time in macOS System Settings. Recess may not function as described if you do.

4. Purchases and Subscriptions

  • Recess may offer one-time purchases or auto-renewing subscriptions. Prices and billing periods are shown in the app before you buy.
  • All purchases are handled by Apple through your Apple ID. Apple charges your payment method, manages renewals, and handles refunds under Apple's refund policy.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in App Store → your name → Subscriptions.
  • We do not see your payment details.

5. Acceptable Use

  • Use Recess for its intended purpose: meeting reminders, screen breaks, and personal time management on your Mac.
  • Do not attempt to bypass Mac App Store licensing, tamper with the app's binaries, or use Recess in a way that violates applicable law.
  • Do not interfere with Recess's operation on devices you don't own or control.

6. Updates, Changes, and Availability

  • We may add, change, or remove features as the app evolves.
  • We may release updates that require macOS updates or new permissions. If we do, the update notes will say so.
  • We aim for a reliable app but cannot guarantee uninterrupted or error-free operation, especially when macOS changes the underlying system APIs Recess relies on.

7. Your Data

How Recess handles data is covered in the Privacy Policy. In short: calendar contents stay on your Mac, and we receive only anonymous diagnostics and any support correspondence you send us.

8. Intellectual Property

  • The Recess app, name, logo, website, and underlying code are owned by Kester Atakere and protected by intellectual property laws.
  • Nothing in these Terms transfers ownership of the app or its assets to you.

9. Termination

  • You can stop using Recess at any time by uninstalling it.
  • We may suspend or terminate access if you materially violate these Terms, with notice where reasonable.
  • Sections about intellectual property, disclaimers, limitation of liability, and governing law survive termination.

10. Disclaimer

Recess is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or that the app will be uninterrupted, accurate, or error-free. You are responsible for your own scheduling; do not rely solely on Recess for time-critical obligations.

11. Limitation of Liability

To the maximum extent permitted by law, Kester Atakere is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, calendar entries, or meetings missed, arising from your use of Recess. Our total aggregate liability for any claim relating to the app will not exceed the amount you paid for it in the 12 months before the claim.

12. Apple-Specific Terms

  • These Terms are between you and Kester Atakere, not Apple. Apple is not responsible for Recess or its content.
  • Apple has no obligation to provide support for Recess. Any warranty claims you raise should be sent to us at hello@kester.work.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes To These Terms

We may update these Terms. The "Last updated" date at the top shows when. Material changes will be highlighted in-app or on this page. Continued use after the change means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of Nigeria, without regard to its conflict-of-laws rules.
